No, you are are probably correct... esp with regard to the Markman, NDist CA ruling and appeal supporting our position on ACP, those other entities settling.. absolutely I would rather be in our position than theirs at this point in time... Now that is not say they still don't have some 'bullets' left.. J Ward has not yet ruled on the ACP motions (even if he rules in their favor, that is no death toll), and then their is KSR/Obviousness.. this is where I believe TPL will concede and give some ground (some doesn't have to be a lot) and move toward a settlement strike along with the defense moving up to settlement... somewhere in the middle.. but more towards our initial settlement price. Settlement before trial
