I would say, all your questions could be answered with: MAYBE or YES!

The trial has to be treated seperately from the USPTO. The judge doesn't wait till the USPTO has finished his work as he like to proceed. However, we have seen in case of the 584' reex. how both things can influcence each other. The offical mediation deadline was without any result. However, a settlement can happen till the trial date.

Wait and see..............all bets are off!
