I've read that ruling several times, and never do I come up with a ruling on Higgins. It only states that prior to Beetie and Osbourne being disqualified Patriot and TPL settled. B&O tried to appeal Higgins but the Appellate court said they did not have standing. Unless it is hidden in there and my eyes are deceiving me, there is no appellate court precedent on Higgins.
