Intel may not have to license, but their customers may have to unless they include a patent indemnification clause in the purchase contracts (and they'd be fools if they didn't, recognizing that Intel has a license).

Along these lines, it is now clear to me that the Js most likely did not have any patent indemnification in their contracts with ARM, otherwise I doubt ARM could bow out.
