I couldn't agree more. The problem is, potential investors will do their DD and say, " Wow he didn't mention they were involved in a huge lawsuit." I would feel almost certain that mentioning the positive Markman, a public record, would not be illegal or ill advised. Potential investors don't like being caught off guard doing their DD.
