The court ruled that

<The specification and prosecution history refer to the fact that operands in the instruction register must be right justified.>

There is little question that the prosecution history does makes some reference to right justification .  Our expert Alvin Despain claims that is a preferred embodiment.  And he further testified that 

<I believe that right-justified operands are not required by the specification or the file history.&gt;

So was Alvin Despain trying to stretch the truth or is a different interpetation of the same file history possible?   Wish I knew. Opty
