Ref the stipulation in orig request for continuance and in response to defendants. In both TPL seems to stressing that the stipulation is based on the court construction of the term "instruction group." Assuming that such wording is in the stipulation, would that mean that TPL could sue ARM again if the construction is appealed and overturned? If the answer to that is yes, then I wonder if ARM would agree to it? Or is that kind of phrasing perfectly acceptable, in which case the court could accept stipulation even if ARM does not?
