You've hit on exactly what I was planning to post about. At this point I believe our team is being completely cooperative with the court, letting the mediation go forward until the opposition 1) demonstrates they aren't negotiating in good faith, 2) the mediation period ends withouit settlement, or 3) settlement is achieved. In the cases of 1 or 2, it'll be time to file for SJ. In the mean time, we look to be the good, guys. 1 or 2, no more Mr. Niceguy, and the court will be much more receptive, I'd think.
