Your last paragraph points to why I'd like to see our team file a motion for SJ on the whole ball of wax.

One can only suspect that mediation is going reasonably well.  One would think that if the defendants aren't negotiating in good faith, our team would just push the panic button and file.  And we'd proabably be backed by the Mediator in doing so.
