What I was trying to post is that I've been through three of these Ex Parte re-exams and they can be frustrating. usually take longer than onje hopes for, the ones I have been through took almost 2 years and they also were supposed to be "Expedited"
In my case though they occurred before the Markman and thatwas delayed all that time till there was an USPTO decision...in our case IMO they markman won't be "re-done" but it will delay any settlements and even the trial if this takes longer than 3 months...so I expect delays to occur. the USPTO is swamped and backlogged even though they have hired on a fair amount of new examiners.
With the air of uncertainty hanging over PTSC I assume will we see a PPS erosion and the longer it goes on the more that erosion will eat away at the PPS.
What we really need is swift positive outcome at the PTO and even more so a relatively quick occurence of licensing with ongoing revenues to start, otherwise IMO the "Shorts" will decend like vultures.
GLTA and I hope ourlayers can get this re-exam completed as quickly as possible within a 60-120 day period.
