If I recall correctly, the litigants have 60 days (calendar) to complete mediation subsequent to the Markman ruling. We're coming up on two weeks since the ruling. So, all other negotiations aside, the clock is ticking on mediation. Will the litigants, each and separately on the opposition side and just us on other side, have to file their selections for mediators with the court (PACER)? Would there possibly be just one mediator for all (seems unlikely)? It would just be nice to KNOW when the mediation can be expected to start. As of today, they have 48 days to finish. Tic-toc......
As for an injunction (the ultimate application of pressure to settle), it seems to me we'd have to file a motion for SJ first, and the Judge would have to rule in our favor. However, I see no reason why we couldn't reiterate our motion for injunctive relief concurrent with the filing for SJ.
