Agreed, TPL and PTSC are still under pressure as well, TPL more so than PTSC. My main message was that there are more than just the immediate legal pressures that the Js are dealing with, and you have only focused on those (and understandably so). But you cannot deny that many non-legal pressures exist, and then there's the point about how, should the Js/ARM lose a court battle, they will need to obtain a license for future infringement as the court will not stipulate contemplative damages. Again, do you think that our team will be in a generous mood when (IF) negotiating licensing fees for future infringement by the defendants?
And, for the record, I do not suggest that anything is a done deal. I'm only suggesting that all litigants have a lot more on their plate to digest than just the immediate legal issues. And while the Js may have circled their wagons together for this fight, they remain business adversaries regardless of the outcome.
