Thanks - That was my gut feeling whenI posted on the 336', and commented on what parts should be given more weight than others.
IMO even though the win/loss count is strongly in our favor, you are correct, their win in the 336 construction is a major hit that you can expect the defense team is relishing, because it will help to blurr and minimize the impact of this patent, and raise doubt as to whether TPL can succeed in  convincing a jury completely.
The question really in my mind, is whether enough damage was done to persuade Matushima to settle, or to proceed onward.
I'm a little worried at the level of euphoria already - All this Markman really did was determine how the deck would be stacked and who may have advantage going to trial.  The overall W/L numbers a re a bit misleading IMO, - I see the overall picture as a bit of a horse race, and more difficult to predict as this time.
