Just wondering where you got "something like 47% of Markman decisions being overturned on appeal", as I don't recall ever seeing that. True?
TIA to you or anyone else that can validate that, and whether it pertained to ED of Texas. It just seems that if that were indeed the case, the Markman may not be the litigation "event" that it's been cracked up to be, and is in conflict with other stats suggesting that, some significant majority of the time, the Markman results in a settlement (via summary judgment or otherwise).
