bring up some good points, but even in links provided aren't the courts saying that extrinsic evidence/expert testimony should not be or should not have been given as much weight in Markman hearings? I would think it could also carry more weight in front of a jury anyway.
The other thought was if PL were here to do damage control for a poor showing by Gafford, why bring the testimony to light? Ease was looking/asking for it for months. It may never have been found. At the time he arrived there was no damage control to do. In fact there was talk that maybe Mr. Cook did not do so well. Just some thoughts.joe
