Past infringer's are now making legal products due to the fact that nineteen (and apparently 22) have paid hundreds of millions of dollars to purchase a legitimate license. 

All of these companies had teams of attorneys at work during all phases of negotiations, up and to their clients purchasing a License from us.

Since counsel was involved in this decision to make these license purchases and (if) subsequently these numerous companies were found not to be infringing, then it seems that they would all be, "Ineffective Counsel"? and subject to penalties for such.
