Still looking for responses

Many posts ago I was asking if anyone had some inkling as to whether our situaltion is in any way unique. (buried under the deluge of junk, sorry but that's was this forum is becoming). Unique in that even though patents under review by USPTO and trial just around the corner, the licenses just keep rolling along. Does this happen often? And the reason for asking is this - if our situation is not common, how can any judge completely dismiss it? But I have no idea what would be considered unusual in a case like this. Legal input welcome. Opty
