Tyler... even if what you say is accurate (which I sincerely doubt) here is a quote from ronran's report today after he attended the hearing. Rmemeber that ronran is an experienced attorney, although not in patent law, and that his experience says it is the written briefs that are most important, not the oral arguments.
"In general, this hearing was exactly what I had expected. My own experience over the years has shown that oral argument to a judge or panel of judges is largely ineffective, and that the decision is usually made from the written briefs — the hearing simply gives the lawyers a chance to emphasize the points that they feel are most important, and for the Judge to ask any questions to get at information that he feels may not have been included in the briefs."
