This approach would still kill the sp.  Using your approach, S&L would have to dump 18MM on the market to stay under the 9.99% limit that they appear to fully intend to stay under.

Other option:  Pay off S&L to retire remaining warrants.  This would take away the need for S&L to sell on open market, but it will still cause sp depression short term due to the effect on revenue.  The Markman hearing will be complete before anything positive could come from this approach.
