I think any price appreciation before the Markman will be countered by those selling the stock and then exercising their warrants, keeping this in the tight range it is and has been for weeks now.

Personally, I've been through two Markmans for other companies and they are never concrete or cut in stone as far as the outcome as expected is concerned. In our case we are defintiely in a pro patent-holder district....BUT...never count those chickens till they're hatched.

The judge has mostly, if not all, the filings in hand by now, he is weighing the points, counter-points made in the filings and will render his decision openly over a day or two period while both sides will have an opportunity to argue the judges findings and try to sway him to reverse or hold tight, his opinion/findings, right there at the Markman.

Now, chances of the judge reversing himself over his findings are slim if any at all...at least in my experiences...After all this time and filings made in a point/counter-point, written argument, by both sets of lawyers, the judge usually walks into that courtroom with his mind set in stone. there would have to be one earth-shattering argument made by the loser of the findings  for him to reverse himself.

That being said, in a day or so after the Markman, and in fact after each days testimony the court usually posts the findings for the public to read and hopefully we'll be able to discern how things are going.

I do not expect the PTSC lawyer team to be on the defensive in this Markman and the price should reflect that...but...the "Street" will still wait anxiously to hear how future licensees are treated and if and how much the revenues will become quaterly/yearly events as opposed to one time settlements.

BTW, that also may be in the Q to show the "Street" the recurring revenues are now in place to help future PE calculations.
