I realize that we are asking for an injunction, but the million dollar  question is, should the case go to trial, and we win, can the verdict withstand the established four-prong test for granting permanent injunctions:

 

(1)   an irreparable harm;

(2) that monetary damages are inadequate;

(3) that an injunction is warranted, considering the positions of defendant and plaintiff; and

(4) public interest would not be served by injunction.

 

 

I would love to see an injunction, but I don’t believe it would be fair based on #4, and IMO, give it a 1% chance of occurring. GLTAL
