The rate at which TPL are signing MMP licensees IMO may reflect the degree of confidence they have in the validity of the patents. If they feared revocation by USPTO or discredit in Markman, I believe they would have been handing out MMPs to anyone with a pen.. for real nuicense values. But they haven't been doing that... Besides NEC settling, only three MMPs in the last 4 months.. IMO that does not lend itself to the appearance of nervousness or fear.
