ease- I am with you 100% and I can understand your initial feeling - the amount of data is overwhelming at best and the amount of references to "Commercial Success" must be in the hundreds if not thousands - how to find the ones that fit us will be a challenge.
I have spent a fair amount of time navigating through the chapters I had referred to me. I took most of what I had said to me, that was not legal opinion, yet rather just an explanation and got my understanding from that. I asked more than once about the "commercial success" importance and was told that it can be a very important factor and even a stand alone factor.
In my reading I found that "Commercial Success" is also often used to override "obvious" art. I also found that only prior patents and prior dated publications can be used by 3rd parties.
Anyway, I was told that "Commercial Success" can be grounds to issue a patent if it meets the criteria (not based solely on big budget advertising etc.)
It is amazing the amount of knowledge and information available there and that we got this far through it in a single day.
