The timing of the injunction request is critical.  Patriot/TPL was forced to request the injunction on Friday. If the Patent Office agrees to re-examine, then Patriot/TPL can NOT request the injunction during a re-examination.  PUBPAT is very aware of this…and at a minimum, they are hoping that the request for re-examination will be accepted (prior to any injunction)…and this buys them time.
