Finally I have a chance to contribute a little. I'm an fpga design engineer with an M.Sc in CompE and about 6 years experience in the industry so I have a little bit of knowledge on microprocessors and variable clocks.
I haven't had a chance to read pubpats patent in detail but after glancing through it at the followign link http://www.freepatentsonline.com/4691124.html, even though it has some similarities there seem to be a lot of glaring differences. While moore's patent specifically addresses a microprocessor (UP), pubpats patent addresses a generic integrated circuit (IC) which could be anything. One difference between the two patents is that while moore's patent specifies that the CPU is within the UP pubpats patent seems to specifiy that the UP is outside. I don't know about patent law that much so I don't know if that in itself gets rid of any prior art issues.
Also moore's patent addresses a lot
of issues such as reduced pin interface to an SDRAM which pubpats patent does not. Also pubpats patent addresses the issue of being able to run the ic at its maximum speed and mainly describes the clock circuitry which enables the ic to run at its maximum speed. Moore's patent addresses achieveing a higher speed by reducing pin count and using multiple instruction fetches which are mainly architecture related improvements as opposed to low level circuit related improvements specified in the pubpat patent. Nowehere in pubpats patent is there a mention of fetching multiple instructions or pipelining.
Again, I have no experience with patent law so I am unaware exactly what would constitute prior art. But at first glance the patents, despite have some similarities are glaringly different and I am not too concerned unless a patent attorney tells me otherwise. Since I am invested in PTSC I will be reading pubpats patent in detail later on and if I find more info will post it.
