Is this actually a delaying tactic or are they nervous about how things are going in Texas? Would not a declaritory judgement come sooner if the Calif court choses to step back in? In which case, it is not so much a delaying tactic as their belief they may have a better shot in Calif vs Texas. Looking forward to hearing what some others have to say.
