I would think that ARM was very ``aware`` of the suit long before Tohiba gave them formal notice (i.e., ARM knew instantly). My thought is that the delay in formal notification was orchestrated, probably by ARM, to buy time and add to the smoke screen.

But I KNOW nuttin`!
