As one who has been there and done that in both trademark and patent litigation, I can guarantee you that the IP insurance folks call the shots, not the brand. Obviously, this applies only up to the limits of the policy. In some cases, the result is far more than the policy and the corporate guys take over. IMO, that is rare, but I have been in one of those nasty deals. Thank goodness for good TM and patent attorneys.
