My SWAG is that TPL has probably already dialed-in a provocative presentation, complete with stats on litigation results for Marshall County Court House.

A thought I have is that, now that the venue for litigation for the J3 is there, any future litigation on the MMP would be held there, or easily manuevered there, because the perceived ``experts`` on the merits (or not) of the MMP subject matter would be there. In other (better) words, future cases will be tried at the court having already experienced the issues at hand, thereby enabling speedier and more efficient action by the court (they would already know the details better than any other court). I base this thought not only on logic, but also based on the recent wrangling over whether the J3 litigation would be held in CA or TX. It seemed the issue as to ``where`` had to do with whether one court was better (or equally) equipped to hear the case. Now that we have our foot in that TX door, it is open for any future litigation based on the TX court inherently being better equipped due to the J3. Efficiency....

And I believe this holds even before any J3 litigation is initiated. It is known that the case will be conducted in Texas, and that case will likely be heard well before any new (other infringer) litigation could possibly be conducted. It`s like a precedent has already been set - litigation re: the MMP will henceforth be conducted in Marshall.

IF my thoughts are correct, that`s a pretty heavy club for TPL to use to pound other infringers into submission. This also feeds my thought that the price tag for settlement may have gone way up. Not only do we have the history of those recognizable names that have already settled, we have what may be an established court venue that is downright ``scary`` for all other infringers.

And all this may be the source of delays in further settlements. Higher price = more time required.

I would like to hear others` thoughts along these lines (particularly Ronran`s).
