Although a win at trial would certainly garner a much larger settlement for us validation of the patents can come in other ways. Settlement by those who are being sued (J3) is an admission that the patents are indeed valid even if they refuse to say so. The amount of the settlement will also tell us just how valid the patents are. If they pay more than nuisance fees, and I would expect they would at this stage, then they are admitting the validity of the patents without going to court.
