He did not say they were a "producing issuer" in the context of a NI 43-101. He said that given that they were now producing product, that may have been the trigger for some scrutiny by the ASC of their past NRs and presentations.

Further, if you go back to the news release you will see that nothing said that "LBE cannot say its a producer until certain gross revenue targets are met."

It states that " The Company has not yet attained the status of a producing issuer defined in NI 43-101 as an issuer which has gross revenues of at least $30 million from the most recently completed fiscal year, and at least $90 million gross revenue in the aggregate over the last three fiscal years."

LBE is clearly producing product through their mill.
