Seriously, in the context of the esker claims, the Minister must decide which is more in the public interest, the Private Ore Road, or the railway, open to use by all? Since there is only a narrow corridor, with no room for both, it is a choice between one or the other.
KWG presumably doesn't need an easement across its own claims, and NOT doesn't seem likely to seek such an easement, as they are hoping for an east-west road.
