Of course 'other interests' can use the surface area of these claims for their own transport preference, BUT as KWG has always maintained, this cannot pre-empt rights over the narrow line already surveyed for the railway. That leaves a large area for others to use. Unfortunate that only a narrow strip is suited to build along, but --
To say that the railway is more 'purely speculative' as against a plan to build an all-weather haulage road by another company is nonsense, and even government people (ie ministers) must know this.
If the Appeal being considered goes for CLF/NOT, and says in effect that they can shoulder KWG's rights aside, and build infrastructure wherever they chooose on these claims, surely the same rules apply to KWG, so that it comes down to whichever builds first has the priority.
