It is likely this next Court date will result in no immediate decision, just a further delay and another Court date.

Even a decision in favour of CLF/NOT application to build a toll road on KWG claims without 'consulting' KWG wouldn't actually change much. Unless of course NOT wants to go ahead and build such a road in the near future. With the process underway to build their East-west road to service their Eaglenest mine, this is unlikely.

Such a decision would also mean KWG could build a pipeline along precisely the same route without consulting NOT and with no regard for their road plans. Both pipeline and road would have equal claim to 'being in the public interest' as both projects would serve the interest of a single company or mine.

Railway along the same route would trump both alternatives (road & pipe) as it would be much closer to something actually 'in the public interest'.
