Some have wondered with all the turmoil in the ROF re Cliffs, if the Leave to Appeal will proceed.

"We are very gratified that this issue will be re-visited by the Ontario Court of Appeal, many of our exploration professionals were left wondering how to protect their investors' interests if claim-staking was no longer to be available for the exclusive exploitation of a discovery. We look forward to the Court of Appeal clarifying this issue, which goes to the root of Canada's world-renowned mining laws and exploration industry leadership".

If his reasoning is correct, this is a much bigger issue than the "dog fight" between Cliffs and KWG. This could have a bearing on all mining claims in the future. This is why I feel this matter has to be properly adjudicated by the Court system so this issue will be resolved to the satisfaction of all concerned parties. According to this Press Release, the 60 day count-down for Cliffs response began on March 2nd and I believe it is now NOT on the other side of the dispute. rj
