My concern now is seeing as the entire issue of easement has basically been put back to square one, will this be the next step the Libs take irrespective of the outcome of the appeal. This imo is what Rickford was referring to when he said the easement never needed to go to the commissioner. It is probably more politically correct for the lib gov to take the step when it can be portrayed as one Cdn co holding back another cdn co as opposewd to being on the side of an American conglomerate that was Cliffs at the time.
"The Divisional Court reasons held, in part: "Whether or not it is in the public interest to grant an easement for a road is a matter for the Minister of Natural Resources to determine, after an environmental assessment and consultation with First Nations and other affected interests. It is for the Minister to determine whether the easement should be granted in the public interest and on what terms. CCC will be able to participate in that process."
