"Whether or not it is in the public interest to grant an easement for a road is a matter for the minister of Natural Resources to determine, after an environmental assessment and consultation with First Nations and other affected interests," the court ruled in July. "It is for the minister to determine whether the easement should be granted in the public interest and on what terms."

Why are Cliffs and the Govt trying to railroad KWG? This is not the ONLY route into the ring of fire, it just happens to be the best. Why should KWG be punished for making smart business decesions? I cannot see KWG losing on the apeal. If Ont wants it, they'll have to pay for the privilege.
If the govt wants to provide a route for the "public good", then choose another route, the E-W route could be for public use.
I also find it interesting that in every news release, KWG reminds everyone that they have completed a 15 million dollar soil sampling along this route.
