Don't quite understand the reason for NOT to appeal the Ontario Mining Recorder ruling. It would appear that this KWG team won squarely by getting out there (ferried around by helicopter) staking out the claims way ahead of the NOT team. The ruling was just to confirm that staking was done properly and hence the claims were officially KWG's. So, what reason is there for NOT's appeal of this ruling. Hopefully, not an application for an easement for some road again (like CLF has done).
I see no gain for NOT by doing so. NOT has plenty in term of Ni, PGM, and chromite in it's vast collection of claims. Hence, there would be no need for this parcel of lands. In view of a potential joint development of Blackbird and KWG/BH, a much better way would be to enter in a negotiation with KWG as a good starting point for a potential JV venture which would involve the use of the land as a future transportation hub, rail plus air, may be road.
Court cases would cost money and time with a potential of creating bad blood...It looks like nothing has been learned from the CLF/KWG example.
