Two minor points - if KWG/CCC had not claimed the entire length of the esker corridor, someone else could have staked claims in between simply in order to block the corridor unless paid off. This would have been possible if they had adhered strictly to the rule (which supposedly exists) allowing only staking 4 consecutive claims in any one direction without expanding the area laterally; secondly, if the Delloitte report, as expected, comes out in favour of rail over road, there is no way a major road along the esker can be construed as being more in the public interest than a railway with service road.
Since there has been no attempt to disallow the claims for any reason, the first point is moot, and any proposal to build a railway must trump any proposed road which does not leave space for the railline as the primary transport means along the corridor.
