Yes. For reasons of "lack of standing", i.e., the right to pursue a lawsuit, KWG motioned the Divisional Court of Appeals not to hear Cliff's motion to disregard OMLC's easement decision and dispense with the need for CCC's consent pursuant to subsection 51(3) of the Mining Act.

Cliff's legal position is a convolution of logic applied to Ontario mining law. However, if the justice(s) decide against KWG's motion to intervene, the hearing of the appeal will take place on June 16 and 17, 2014.
