Just wondering what CLF could submit (no new evidence allowed, except in special circumstances) to say that the Commissioner erred in the judgement. It must be procedural or something along the line that "the law of the land (the Act)" did not apply in this case. They would need a team of really brilliant lawyers to argue as to why this ruling should be overturned.
