The following excerpt from the decision says a lot on what is at stake in the Cliffs' easement application. We can better understand why KWG (the surface claims' holder) made - and still makes - efforts to building its case during the last year or so (ie, acquiring additional claims, assaying the RR claims sampling, etc... and also today's application for permits regarding the RR corridor mining claims):
"(The tribunal notes that under rigorous questioning by the tribunal on the point of what was being referred, the MNR’s counsel, Mr. Burke stood fast and advised that "an application…gets referred for a determination of the issue…whether the refusal to provide consent is reasonable…." He added, "…the Commissioner says what the issue is…, …whether there are multiple uses, and whether the uses can co-exist.")"
KWG has to convince the Commissionner that they had good reasons for refusing the easement to Cliffs. One of which will be that Cliffs is trying to use an indirect way to "expropriate" its JV partner's transport corridor in order to benefit alone from its wholly-owned Black Thor property, while letting its partner dry with his 30%-owned Big Daddy property. Frank Smeenk said he will make all he can to avoid his shareholders to wait until the next Century before mining their chromite!" It may be less than a Century, but Cliffs could also be a long way from its mine, too! You can still make an Offer, Mr Boor, we'll certainly look at it closely!
