A notice was posted to SEDAR by the company stating that as of the 24th August, the company ceases to be a reporting issuer. This is a VOLUNTARY surrender of reporting issuer.
The important conditions attached to the BC order are as follows:
- The stock is closely held(which is what has been discussed on numerous occasions, there would have to be less than 50 beneficial shareholders)
- the stock as it is listed on OTC U.S. markets is unsubscribed, thus does not apply here(interesting enough)
Also this voluntary order was rescinded and replaced by the new conditions, but the word missing is VOLUNTARY.
The other condition of some importance is that a trust ceases to exist, namely if a defeasance irrevocable trust was in place and ceased to exist, this was one of the conditions under securities law that allow the surrender of reporting issuer.
