Yeah, naked shorting is definitly still going on, although illegal. Its so easy for them to manipulate the laws in place. It is very hard for a commission to get enough proof on these kind of practices because of the thin to none paper trail.
The only thing I have found so far, that may indicate a naked short position on a stock is;
REG SHO THRESHOLD SECURITIES LIST
It is a service you can subscribe to offered by TMX Datalnx. It shows the"failure to deliver"s on stocks for the TSX, I beleive. There are other lists offered by different providers, for ex, NASDAQ has one.
