NOVAWEST FILES ACTION AGAINST STOCKGROUP MEDIA INC. AND POSTER "4SEER" Novawest Resources Inc. has filed a writ of summons in the Supreme Court of British Columbia naming as defendants Stockgroup Information System's Stockgroup Media Inc. and an anonymous John Doe, posting under the name 4seer. The defendant, Stockgroup, carries on business as the operator of a number of Internet websites, the Stockgroup network of sites. John Doe, who has identified him or herself as 4Seer, is a registered member of Stockhouse. On, or about, Dec. 4, 2007, Stockhouse falsely and maliciously published and/or posted or caused to be published and/or posted numerous defamatory messages written by John Doe, also known as 4Seer, of and concerning the plaintiff, Novawest Resources. By reason of these publications, the plaintiff has been seriously injured in character, credit and reputation. The plaintiff claims against the defendants the following: 1) a mandatory injunction to immediately remove the messages posted by the defendants until the trial of this action or until further order of the court; 2) an injunction restraining the defendant, Stockgroup, from publishing or posting any further messages written by the individual known as 4Seer, regarding the plaintiff, until the trial of this action or further order of the court; 3) a mandatory injunction compelling the defendant, Stockgroup, to disclose forthwith to the plaintiff the name and address of the individual known as 4Seer, as well as any additional pseudonyms used by this individual of which Stockgroup is aware; 4) general damages; 5) special damages; 6) aggravated damages; 7) punitive damages; 8) costs of this action; and 9) such further and other relief as the court may deem just. Statements transmitted and published over Stockhouse's website about particular companies are accessible by millions of individuals, including potential investors, and the extent of the damage could be considerable. The allegations in the statement of claim have not yet been addressed or proven before the courts, and no statement of defence has yet been filed.
