I would assume that just as there would be a fiduciary duty or obligation of the vendor/Optioner to give all info gathered on the property to the Optionee, that the reciprocal would hold true as well, in the event of termination of the Option Agreement.

I will give Mr. Peter Smith et al. the benefit of the doubt on this (ie. that adequate contractual protection is in place) , as this surely is not his first rodeo .
