Hi Borelly,
There are no time constraints to cover. They can remain short forever but this recent news destroys their thesis for shorting in the first place, (i.e. EFL is a failure and doomed for bankruptcy). We've been hearing that for years yet here they are rising from the ashes, ... again. As with most penny stocks, there are some very bitter and unstable "investors" hurt by the volatility and looking to hurt someone for their losses.
Because most shares are held in "Street Name" at the Brokers, it is easy to borrow shs to short. To be sure yours don't get used, you can either tell your Broker not to lend them out, ask for the actual Stock Certificate or put in a high sell order to lock them up. The absolute best way to hinder the shorts, is as we have eluded. Get the company to perform and no one will want to.
