well, E*Trade is standing their ground and removing KRY shares from active portfolios at end of May.  Their reply to my cogent explanations and sharing Computerserve's Ms Walsh at POC:

E*Trade replies: After reading your message I understand your concern. E*TRADE uses the services of the DTC / DTCC (Depositary Trust and Clearing Corporation). The PREM program is maintained by the DTC. There is no option for an exception to this process. However the removal is not expected to interfere with a settlement. Statements and trade confirmations (up to 7 years) would be available online. Crystallex Corp would have to work with the DTC in order to ensure the security is no longer be eligible for PREM removal.
