(1) No. The court is responsible for determining when to pay off creditors, the timeframe is at court speed (a pace which makes snails look fast). It is in progress with Justice Newbould tasked with doing this.

(2) Greater probably but not far greater. Tenor would like it to happen quicker.

(3) The court will decide that. Normally a plan of arrangement would be agreed first, then creditors paid then exit from CCAA.

(4) No. Once out of CCAA Tenor could (and most likely would) take 88+% share ownership and are not subject to any more regulation than an unlisted private company. In some ways shareholders have more protection inside CCAA.

The key to all of this is what many here ignore: once Crystallex entered CCAA, shareholders were essentially irrelevant. Shareholders can complain and whine and say it is not fair but not much else.
