I'm not "in" with a Gowlings lawsuit, as you know I see that as a waste of time and money - my guess is a minimum of 5% of our net if they go to court (win or lose). The best case is that Gowlings win without going to court and the only cost is for the opt-ins.

I'm not sure our share is 12% (11.746%) - it is called a waterfall provision which implies it changes the higher the award - hopefully it means we get more than 12% net if the full award is paid out. I don't know why it became a waterfall agreement - everything went dark at that time and remains that way. Again I'm not clear why they needed to redact the documents - collusion between the noteholders and VZ seems the only rationale no matter how implausible. Collusion between Tenor and Fung seems obvious.

I agree we would be nowhere without Tenor. Typically the route Crystallex has gone should wipe out shareholders. I'm certain if the noteholders had their way we would have been.

I suspect 38 cents per share would be a huge relief to many if not most shareholders. (My guestimate was 25 cents).
